Terms of Use

These terms govern your purchase and use of Peak ("the app", "we"). By installing, opening, or using Peak you agree to them. If you don't agree, do not install Peak; request a refund per the section below.

License

Peak is distributed through the Mac App Store. Your use is governed by Apple's standard Licensed Application End User License Agreement (the "Standard EULA") together with these terms; where they conflict on app usage, Apple's Standard EULA controls. In addition, you agree not to:

Under the App Store's terms you may use Peak on any Mac associated with your Apple ID. There is no separate license key.

Acceptable use

You are responsible for ensuring that your use of Peak complies with all laws applicable to you. In particular:

  1. Devices you own or control. Peak is intended to scan iPhone backups stored on a Mac you own, of devices owned by you or used by your minor child in your custody. Scanning the messages of another adult without their knowledge or consent is illegal in many jurisdictions under federal wiretap statutes and state two-party-consent laws. Do not do this with Peak.
  1. Minor children. Parental supervision of a minor child's device is generally lawful in the United States and most other jurisdictions. The legal analysis for your specific situation may vary; consult a lawyer if you have any doubt.
  1. Compliance with terms of third-party services. iMessage and SMS messages may contain content sent by users of other platforms. Your scanning of locally-stored backup data does not, in our reading, breach the terms of service of those platforms — but we make no warranty to that effect.
  1. No abuse. Do not use Peak for stalking, harassment, surveillance of partners or ex-partners, employee monitoring without disclosure, or any other use that would be illegal or unethical. Such use is grounds for license termination without refund.

Refunds

Peak is sold through the Mac App Store, so Apple handles all payments and refunds. To request a refund, use Apple's process: visit reportaproblem.apple.com or your Apple purchase history and request a refund for Peak. Refunds are granted at Apple's discretion under its standard policy; we are not the merchant of record and cannot issue refunds directly.

Disclaimer of warranty

PEAK IS PROVIDED "AS IS". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT PEAK WILL CATCH EVERY PIECE OF INAPPROPRIATE CONTENT, OR THAT FLAGGED CONTENT IS ACCURATELY CLASSIFIED. PEAK IS A FIRST-PASS TOOL THAT SUPPLEMENTS HUMAN JUDGMENT; IT DOES NOT REPLACE IT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF PEAK IS LIMITED TO THE AMOUNT YOU PAID FOR PEAK IN THE PRIOR 12 MONTHS. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES OF ANY KIND.

This is a limited-purpose tool sold for a low one-time price. The terms reflect that.

Updates

Updates are delivered through the Mac App Store and may include bug fixes, new features, security patches, and modifications to user-interface text. Significant changes will be summarized in the App Store release notes. You can manage updates in System Settings → App Store.

Major version upgrades (e.g. Peak 2.0) may be offered as a separate paid purchase on the App Store. You will not be auto-charged; any upgrade will be optional.

Termination

Your license terminates if you violate these terms. We may also discontinue Peak (remove it from sale) at any time; copies already installed continue to work. Any refunds remain subject to Apple's App Store refund policy.

Governing law

These terms are governed by the laws of the developer's jurisdiction (to be specified before launch — e.g. California, USA). Any dispute will be resolved in the courts of that jurisdiction.

Changes to these terms

We may update these terms. The current version is always at phonepeak.app/terms. Material changes will be announced in release notes. Continued use of Peak after a change indicates acceptance. If you do not accept new terms, you may request a pro-rated refund within 30 days of the change.
